GENERAL TERMS AND CONDITIONS OF SALE
1. Purpose
These general terms and conditions of sale are intended to define the rights and obligations of SARL Galerie Woolworth and of the Customer with respect to the jewelry presented by Lou Woolworth on her website www.galeriewoolworth.com (hereinafter referred to as "the Site"). They apply exclusively between the company Galerie Woolworth, trading under the name Galerie Woolworth, located at 51 rue de Seine, 75006 Paris, SIRET number 437 826 712 00014 (hereinafter “Lou Woolworth” or “Galerie Woolworth” or “the Seller”), and any individual consumer visiting or making a purchase through the Site (hereinafter “the Customer”). On the Site, Lou Woolworth enables the Customer to order online jewelry sold by Lou Woolworth (hereinafter “the Jewel” or “the Jewels,” referring interchangeably to one or more products depending on the context) under these general conditions. Any order placed with Lou Woolworth therefore implies the unconditional acceptance by the Customer of these terms and conditions. These general terms and conditions may be modified at any time and without prior notice by Lou Woolworth, with the applicable version being the one in force at the date of the Customer’s order. Any transaction between a Customer and Lou Woolworth involving a creation, re-creation, or custom-made product is excluded from the scope of online sales, as it is handled directly between the Customer and Lou Woolworth. These general terms and conditions of sale are permanently accessible on the Site in an electronic format that allows them to be printed and/or downloaded, so that the Customer can reproduce or save them.
2. PRODUCTS AND CONFORMITY
2.1. The Jewels sold through the Site—thus excluding any custom-made creations carried out outside the Site’s framework—are antique jewelry and should therefore be considered second-hand goods.
2.2. The Jewels offered for sale are presented on the Site and accompanied by a description. The Customer is required to consult the descriptive sheet for each piece in order to learn about its characteristics and, where applicable, its care and use conditions.
2.3. The Jewels offered by Galerie Woolworth comply with the legislation in force regarding the trade of precious metals and gemstones (see section 12.4). The photographs and graphics of the jewelry presented on the Site are provided for illustrative purposes only and are not contractual. They shall in no way engage the responsibility of Galerie Woolworth.
3. CUSTOMER OBLIGATIONS
3.1. The Customer declares that they are at least 18 years old and have legal capacity, or hold parental authorization allowing them to place an order on the Site.
3.2. By placing an order on www.galeriewoolworth.com, the Customer declares and guarantees that they are a bona fide end user and undertakes not to deliver, sell, or distribute in any way the Galerie Woolworth jewelry, nor to purchase the jewelry for any commercial purpose. Any order placed in violation of this clause shall be deemed null and void.
3.3. The Customer undertakes to provide Galerie Woolworth with accurate and necessary information required to perform the services covered by these terms, as requested online and according to their situation, including but not limited to their last name, first name, address, telephone number, and a valid email address. The Customer is responsible for any consequences resulting from false, inaccurate, or unlawful information provided.
3.4. Once the order has been placed, Galerie Woolworth sends the Customer an email confirming the order and informs them of the shipment of the jewelry.
3.5. The Customer may modify their personal details in the “My Account” section.
4. ORDER
4.1. Placing an order
Orders are placed from the catalog available on the Site. The Customer selects the desired jewelry item by clicking “Add to Cart.” The Customer completes the order by clicking “Check-out” (or equivalent).
At any time, the Customer may:

review the jewelry in their cart, including quantity, price, and detailed information by clicking on the “My Cart” icon;

modify or cancel an item on the cart summary page;

continue browsing jewelry;

validate the order by clicking “Validate My Cart” on the cart page displayed after adding a product.
4.2. Order validation
To place an order, the Customer, after filling their virtual cart, clicks the “Order” button and provides delivery and payment information. Before confirming the order, a summary is provided allowing the Customer to review order details and total price and to correct any errors or modify the order. Delivery costs are communicated before order validation (see Article 7 – DELIVERY). Confirmation of the order constitutes acceptance of the General Terms and Conditions of Sale and forms the contract. No order shall be validated until payment has been accepted.
4.3. Galerie Woolworth reserves the right to cancel or refuse any order in the event of a dispute with the Customer relating to a previous order.
4.4. Galerie Woolworth accepts orders subject to available stock. The Customer is informed of the availability of jewelry at the time of order confirmation. Only products identified as available on the date of the order may be sold.
5. PRICES
5.1. Prices displayed on the Site are indicated in euros, inclusive of all applicable French taxes (French VAT and other applicable taxes).
5.2. Prices may be modified at any time without notice, particularly in the event of changes in fiscal or economic data. Items will be invoiced based on the rates in effect at the time the order is recorded.
6. PAYMENT
Full payment must be made at the time of order, except where installment payment facilities are offered. At no time shall sums paid be considered as deposits or down payments. Payment is made by credit card (Visa, Eurocard/Mastercard). For any card transaction, the Customer must provide the card number, expiration date, and security code. Providing card details constitutes authorization for Galerie Woolworth to debit the Customer’s account for the order amount. Cash on delivery is not accepted. Galerie Woolworth retains ownership of the item until full payment is received. Payments are secure and all transmitted information is strictly protected.
7. DELIVERY
7.1. Galerie Woolworth offers shipping and delivers jewelry in France and worldwide. Customs fees are fully borne by the Customer and payable after quotation. Jewelry is shipped with a value certificate for insurance purposes to the delivery address provided. Delivery cannot be made to hotels or post office boxes. Delivery times are indicative. The Customer must ensure accurate delivery information. All shipments are made via DHL, FEDEX, or UPS. Galerie Woolworth guarantees against loss or theft during shipment. Any damaged package must be reported within 3 days of receipt. Galerie Woolworth is not responsible for delays not attributable to it.
7.2. Receipt of the jewelry is confirmed by the signature of an adult. Upon receipt, the Customer must verify the apparent conformity of the jewelry with the order.
8. EXCHANGES AND RETURNS
8.1. Right of withdrawal
Customers residing in the European Union or European Economic Area benefit from a 14-day right of withdrawal without justification. The withdrawal period expires 14 calendar days after receipt of the goods. In accordance with Article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to customized, adjusted, engraved, or hand-delivered jewelry. To exercise this right, the Customer must notify Galerie Woolworth by email.
8.2. Product returns
If notified electronically, Galerie Woolworth will acknowledge receipt of the withdrawal. Within 14 days of receiving the order, the Customer may request a return by email. Return shipping costs are borne by the Customer unless the product is incorrect. Damaged, worn, engraved, customized, or resized products will not be accepted. Returns are at the Customer’s risk and must be insured for the purchase value. Products must be returned in original packaging to:

Returned jewelry will be refunded in the form of a credit note within 15 days of receipt.
9. WARRANTIES AND LIABILITY
Galerie Woolworth is bound only by a best-efforts obligation. Its liability shall not be engaged for internet-related issues or force majeure events.
9.1. Legal guarantees
Jewelry benefits from the legal conformity guarantee (Articles L.217-4 to L.217-14 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).
9.2. Guarantees specific to precious metals and gemstones
Jewelry complies with Decree No. 2002-65 of January 14, 2002, and related tax and regulatory provisions.
9.3. Personal data
Galerie Woolworth processes personal data in compliance with French data protection laws. Customers have rights of access and rectification. Requests should be sent to contact@galeriewoolworth.com.
10. INTELLECTUAL PROPERTY
All content on the Site is protected by intellectual property rights and remains the exclusive property of Galerie Woolworth. Any unauthorized use is prohibited.
11. FORCE MAJEURE
In the event of force majeure, obligations are suspended for the duration of the event. If it exceeds three months, the contract may be terminated without compensation.
12. GENERAL PROVISIONS
12.1. Partial invalidity of a clause does not affect the validity of others.
12.2. Terms may be updated at any time.
12.3. Applicable law: French law. Competent courts are French courts unless mandatory consumer protection rules apply.
12.4. Reproduction of applicable legal texts (Consumer Code, Civil Code, Decree No. 2002-65).
